Lipsig obtains $5 million settlement for construction laborer

Our 30-year-old Lipsig client is a laborer who fell while working on a construction site. Lipsig partner Charles Wisell proved that the owner and general contractor violated NY Labor Law §241(6) when they allowed the work site to be covered with carelessly stored construction materials and debris, exposing all of the workers to the risk of serious injury. Lipsig’s client, moving concrete cinder blocks, fell due the defendants’ work-site safety rule violations. Lipsig successfully moved for summary judgment.

Despite two fusion surgeries, our client remained disabled and unable to return to work. His lumbar fusion surgery failed and left him with chronic pain.
