Brooklyn Scaffolding Accident Lawyers

Brooklyn Personal Injury Attorneys Helping Scaffolding Accident Victims Recover Compensation

When a piece of scaffolding collapses at a busy Brooklyn construction site, it can cause injuries, not only to those workers on the scaffolding but also to innocent bystanders on the ground. These injuries can require long periods of medical treatment, pain and suffering, hospitalization, and missed time from work. All of this is compensable under the law.

If you were injured in a scaffolding accident while you were working at your construction job, you may have a legal claim for workers’ compensation benefits. The Brooklyn scaffolding accident lawyers at Lipsig, Shapey, Manus & Moverman understand the significance of these injuries and how debilitating they can be. You should feel free to give us a call or contact us online to find out how we could assist you throughout your legal matter.

OSHA Regulations Regarding Scaffolding

In workplace accidents that involve scaffolding on construction sites, Occupational Safety and Health Administration (OSHA) regulations become significant. In the event a construction company or employer violates one or more of these regulations regarding scaffolding, they can be legally liable. With regard to scaffolding, the following OSHA regulations are applicable:

  • Scaffolding on job sites must be capable of supporting at least four times the expected maximum load amount

  • Workers have to be given an access ladder or some other reasonable means of gaining access to the scaffolding

  • Construction companies must immediately repair any damage to a piece of scaffolding which is located on a construction site. Workers are not permitted to use the scaffolding until these repairs are made

  • Concrete blocks and other movable objects may not be used to secure scaffolding on the ground

  • All planks of scaffolding must be tightly secured

When construction companies do not follow these regulations with regard to their scaffolding, and a serious fall or injury occurs, the injured worker may be able to file a claim for negligence against the construction company.

Workers’ Compensation Liability

In addition to a potential negligence claim against the construction company, an injured worker who falls from scaffolding while on the job may be able to file a workers’ compensation claim against the employer. As part of this claim, the injured worker might be able to obtain monetary benefits for a portion of the lost earnings, medical expenses, and permanent or temporary disability. In some instances, the worker may also qualify for vocational rehabilitation training.
