5 Injured when Car Jumps Curb

November 20, 2020
ny pendestrians

When it comes to traffic accidents, pedestrians are obviously most vulnerable to serious injuries. When you’re on foot, after all, there is nothing to protect you from the immense impact of any ensuing accident. A recent car crash in Crown Heights – as reported by CBS NEW YORK – highlights this point quite succinctly. If a motorist’s negligence leaves you or someone you love injured in a pedestrian accident, reach out to an experienced NYC personal injury attorney today.

The Accident in Question

The accident in question occurred at about 7:30 PM on September 21 when a car jumped the curb at Atlantic Avenue and Thomas Boyland and crashed into a building – hitting pedestrians on the sidewalk along the way. Police on the scene shared that the impact from colliding with another vehicle sent the car barreling over the curb, across the sidewalk, and into the building. Five pedestrians sustained injuries (that were deemed not to be life-threatening) in the crash and were transported to the hospital.

Pedestrian Accidents

While pedestrians have a responsibility to cross streets safely, this is a clear example of a pedestrian accident that has nothing to do with the pedestrians’ actions – other than being in the wrong place at the wrong time. In fact, there was a 7.5 percent increase in the number of pedestrian fatalities on New York City streets in 2018 (over 2017) – according to STREETSBLOG NYC.

Damages Sustained

The damages pedestrians sustain in pedestrian accidents are often considerable and can include:

  • Medical costs – Pedestrians are so vulnerable to the impact of traffic accidents that the injuries they incur tend to be very serious, which translates to extensive medical expenses.
  • Lost wages – Serious injuries typically mean a significant loss of hours on the job and a subsequent wage decrease throughout the recovery process (which can be protracted).
  • Physical and emotional pain and suffering – The physical pain and suffering associated with pedestrian accidents are obviously immense, but the emotional pain and suffering can be even more serious – and more difficult to conquer.

Pedestrians have the absolute right to get around safely on foot, and the superior might of motor vehicles does not make their drivers right when it comes to their actions. Motorists are required to adhere to the rules of the road, which include safely accommodating pedestrians in their midst. When they fail to do so, such as in this prime example, they are responsible for all ensuing injuries.
