Construction Worker Deaths on the Rise

7 Mar 2019

Despite significant regulation, the construction industry continues to see too many serious accidents that result in catastrophic injuries and even death. Unfortunately, statistics have shown that the industry has a lot of work to do to improve its safety.

At Lipsig, Shapey, Manus & Moverman, we represent construction workers in lawsuits for compensation. If you need assistance, please reach out to one of our New York City construction accident attorneys for more information.

Uncomfortable Numbers

From 2015 to September 2017, 40 construction workers in New York City died. This startling number prompted the City Council to require workplace safety training, with the hopes that the training would bring the numbers down.

The council’s strategy seems to have paid off. According to statistics from the New York Committee for Occupational Safety and Health, 20 construction workers died in New York City in 2017, and 69 died throughout the state. Fatal falls made up roughly half of all fatalities.

This organization also measures the fatality rate in the state, which is an important number. If fewer people are working in construction in any given year, then the numbers of fatalities should fall. This does not mean that the industry is safer; instead, it only means fewer people are working in the industry.

The fatality rate measures the number of deaths per 100,000 full-time equivalent workers. And this measure is disturbing. The fatality rate for New York state has increased 39% in the past five years. By contrast, the fatality rate in New York City has declined 23%--not great, but not as bad as in other parts of the state.

Legal Help after a Death

If you lost a loved one in a construction accident, then you might be confused about your legal options. In New York, the estate’s personal representative can bring a wrongful death lawsuit to recover for the economic losses caused by this untimely death.

Wrongful death cases are not easy to bring, and the state’s workers’ compensation laws often protect employers. However, there are exceptions, particularly when a construction worker is killed. Many of our clients have been able to maintain these lawsuits against culpable entities, including manufacturers, property owners, general contractors, and others.

If you prevail, you can receive compensation for the lost support and services you would have received from your loved one had they lived. In some cases, our clients receive considerable sums that can make moving forward possible after the tragic construction accident death.
