Recent Brooklyn Accidents Illustrate the Dangers to Pedestrians

November 8 2019

With so many people moving around in Brooklyn at all hours of the day and night, it is no surprise that traffic accidents happen. Lately, however, there has been a rash of collisions between vehicles and pedestrians in the Brooklyn area, some of which have had tragic results. If you are in a pedestrian accident in Brooklyn or any other borough, you should contact the pedestrian accident attorneys at Lipsig, Shapey, Manus & Moverman P.C. right away.

Hit-and-Run Pedestrian Crash

At the end of September, news outlets reported a hit-and-run collision involving a 47-year-old male pedestrian. The collision took place at about 3:40 a.m., and the driver of the SUV did not stop after hitting the man. Other drivers stopped to help the pedestrian, who landed on the side of the road by a tree. Reports indicate the man was taken by ambulance to Brookdale Hospital, and he was in critical condition due to head trauma.

Pedestrian Dies in Collision

Two days after the above accident, a 2002 Dodge Stratus hit a pedestrian who was crossing Flatbush Avenue in Park Slope right after midnight. Emergency medical technicians transported the victim to Brooklyn Hospital Center, where he died from his injuries. Reports state that the pedestrian was crossing the street without a proper walk signal when the crash occurred. The driver involved underwent field sobriety tests, though the news did not state whether the driver was arrested and charged with a crime.

Liability for Brooklyn Pedestrian Accidents

Often, determining liability for pedestrian accidents can be straightforward, such as when a driver fails to follow traffic signals or yield to pedestrians in a crosswalk with the right-of-way. In some cases, however, liability can be a more complicated matter.

First, many pedestrian accidents happen at night, like both of the above incidents. Pedestrians might be difficult to see at night, but drivers should take extra care to watch for people walking. In addition, while the fatal accident involved jaywalking, drivers should be paying close enough attention to the road to be able to stop even when someone is crossing against the walk signal.

Often, pedestrian accidents are hit-and-run. This is often the case at night, as a driver might be impaired or have contraband in their vehicle. Pedestrians often do not get the medical attention they need immediately when someone leaves the scene of the accident, especially if it happened at night. This can result in unnecessary fatalities in many situations.

In general, pedestrians tend to sustain devastating injuries in collisions with motor vehicles. The losses to injured victims or surviving family members can be immense, and it is important to consult with a pedestrian accident attorney who can protect your rights to full financial recovery from a negligent driver.
