Fatal Construction Accident in Queens

June 25, 2022
Construction site

About 3 pm on April 6, 2022, FDNY officers responded to an accident report in Ridgewood where a construction worker had fallen approximately 20 feet down a huge hole. The officers managed to rescue Holger Molina Pinos alive but in critical condition. He was rushed to Wyckoff Hospital but succumbed to his injuries shortly after. Holger is survived by his wife and three children and died two days before his 47th birthday.

Based on witness accounts, Holger, who was working on a building on St. Nicholas Ave. near Myrtle Ave., was loading materials on the building’s first floor when he suddenly fell down an elevator hole leading to the basement. Witnesses also said that Holger was made to work even if it was raining. Investigators from the NYC Department of Buildings (DOB) arrived hours after the incident and concluded that Holger was moving a plywood sheet when he slipped and fell.

Sadly, this isn’t the first time that a construction worker was hurt on this project. Holger’s fatal accident was actually the second accident at the residential construction site, following a violation in February for failure to report a prior injury when another worker was hit by a fence gate while working.

Residents of Ridgewood also said that the construction workers were forced to work in deplorable conditions, so they have filed a complaint with the project’s developers. They want to pause the project indefinitely until the developers create and enforce a solid safety plan for their construction workers. The developers have yet to respond. Holger’s family will also file a claim against the negligent developers and other relevant parties.

Pursuing a Wrongful Death Claim After a Fatal Construction Accident

Various things can easily go wrong during construction projects, and working conditions can change very quickly, placing the lives of workers at risk if relevant parties fail to ensure the construction workers’ safety. If a loved one was killed in a fatal construction accident due to someone else’s recklessness or negligence, you might be entitled to bring a wrongful death claim.

When evaluating your claim, your Queens wrongful death attorney will review your damages to ensure that you receive fair compensation for them on behalf of your deceased loved one:

  • Burial and funeral costs
  • Reasonable healthcare or medical costs associated with your loved one’s final illness or injury
  • Monetary support your loved one would’ve contributed to your family
  • The value of parental care, guidance, and nurturing to surviving children
  • The value of services and support your loved one would’ve provided to your family
  • Conscious suffering and pain your loved one endured due to their final illness or injury
  • Survivor’s lost inheritance
  • Interest on the award for damages, calculated from your loved one’s death date
