Fatal Motorcycle Crashes Still Happening in New York City

October 9, 2022
Motorbike crash scene

Just before 1 p.m. on July 17, a motorcycle exploded following a devastating crash that killed one motorcyclist and injured two others in the Edgemere neighborhood at the Rockaways. A 52-year-old man was driving north in Beach 45th St. and crashed into two motorcyclists heading west near Beach Channel Drive.

One of the motorcycles caught on fire upon impact, and one of them was pinned to a fence by the vehicle that hit it. One of the motorcyclists was pronounced dead right on the accident scene, and one of them, a 33-year-old man in critical condition, was transported to Jamaica Hospital. The driver, who was in stable condition, was transported to St. John’s Hospital.

According to bystanders, Beach Channel Drive is notorious for drag racing. Approximately 290 people have been seriously injured in this specific 1-mile stretch of roadway that cuts through Edgemere since 2011. In addition, according to NYC Crash Mapper data, 1,559 motorcycle crashes have occurred in the city between January and September 2022. These crashes have resulted in 1,764 injuries and 33 motorcyclist deaths.

Filing a Wrongful Death Claim After a Fatal Motorcycle Crash

Deadly motorcycle crashes usually occur due to the negligent actions of the motorists they share the road with. A lot of these crashes could’ve been prevented, and lives could’ve been saved if drivers had been more careful. When negligence results in a person’s wrongful death, their personal representative may pursue compensation on behalf of the deceased’s family members.

In New York, the personal representative of the deceased’s estate must file the wrongful death claim. Unlike in other states, New York will only allow a family member to file a wrongful death suit if they are also the personal representative of their deceased family member’s estate.

When filing a wrongful death claim, the plaintiff is seeking damages or losses, which will be awarded to the surviving family or estate of the deceased individual. The specific types and amount of damages sought would depend on the particular circumstances of the wrongful death. Generally speaking, wrongful death damages in New York usually include the following:

  • Burial and funeral costs
  • Reasonable and necessary medical costs associated with the deceased individual’s final injury or condition
  • Any financial assistance the deceased individual would’ve provided to the surviving family members
  • The value of services and support the deceased individual would’ve provided had they lived
  • The value of parental guidance, care, and nurturing to surviving children
  • Pain and suffering the deceased individual endured due to their final injury or condition
  • Surviving family members’ lost inheritance
