UTICA, NEW YORK (February 8, 2018) – A Brewerton man was seriously injured after the pickup truck he was driving stalled and was rear-ended in an accident with a semi truck.

Utica authorities have been able to identify the man that was injured in the pickup truck collision as Brett Sullivan.

Brett Sullivan was driving westbound on the Interstate 90 Highway Thruway when his vehicle became disabled. A semi truck driving the same direction collided with the back of the victim’s vehicle.

Firefighters and paramedics rushed to the scene of the accident in order to rescue the injured pickup truck driver.

Brett Sullivan was flown to the Upstate University Hospital in critical condition.

LIABILITY IN TRUCK ACCIDENTS WITH DISABLED VEHICLES

Truck drivers have a responsibility to maintain a reasonably safe distance between themselves and the vehicle in front of them. Truck drivers should never be close to a vehicle so that they can rear-end it, even if the car is stalled in the middle of the roadway. A trucking company may be vicariously liable for an accident if one of their drivers causes a rear-end collision while working within the scope of their employment. In addition to driver negligence, there may also be negligence on the part of a car manufacturer if a defect in a vehicle caused a car to stall dangerously on the freeway. For example, the ignition switch on a number of cars have malfunctioned and caused cars to suddenly and dangerously stop on the highway. Over 124 deaths and 275 injuries have been linked to faulty ignition switches.

Our staff at Lipsig Lawyers were deeply concerned to learn about the truck accident that injured Brett Sullivan on the 90 Highway.
