LIABILITY IN TRUCK ACCIDENTS WITH DISABLED VEHICLES
Truck drivers have a responsibility to maintain a reasonably safe distance between themselves and the vehicle in front of them. Truck drivers should never be close to a vehicle so that they can rear-end it, even if the car is stalled in the middle of the roadway. A trucking company may be vicariously liable for an accident if one of their drivers causes a rear-end collision while working within the scope of their employment. In addition to driver negligence, there may also be negligence on the part of a car manufacturer if a defect in a vehicle caused a car to stall dangerously on the freeway. For example, the ignition switch on a number of cars have malfunctioned and caused cars to suddenly and dangerously stop on the highway. Over 124 deaths and 275 injuries have been linked to faulty ignition switches.
