MUNICIPAL LIABILITY FOR ACCIDENTS AND INJURIES WITH FALLING TREES
Cities in New York have a duty of reasonable care in regards to trees that are on public property. Periodic inspections must be done in order to determine if any trees are in a dangerous condition. A person that is injured or killed by a falling tree will likely be able to file a claim against the city where the accident took place if city officials knew (or should have known) about a dangerous condition posed by the tree. In Handwerker v. City of New York, a 29-year-old social worker was pinned to the ground and badly injured by a falling tree. The city elected to settle with the family in light of evidence that it failed to inspect a tree trunk that was dangerously rotten and “gooey.”

There needs to be a thorough investigation into this accident for the sake of all of those that have been affected and so that the family can have closure.
