MUNICIPAL LIABILITY FOR ACCIDENTS AND INJURIES WITH FALLING TREES

Cities in New York have a duty of reasonable care in regards to trees that are on public property. Periodic inspections must be done in order to determine if any trees are in a dangerous condition. A person that is injured or killed by a falling tree will likely be able to file a claim against the city where the accident took place if city officials knew (or should have known) about a dangerous condition posed by the tree. In Handwerker v. City of New York, a 29-year-old social worker was pinned to the ground and badly injured by a falling tree. The city elected to settle with the family in light of evidence that it failed to inspect a tree trunk that was dangerously rotten and “gooey.”

Our staff at Lipsig Lawyers were deeply saddened to learn about this horrific car accident involving a falling tree that killed Zafar Rustsmor. Our thoughts and prayers are with the family of the victim as they go through such an incredibly difficult time. Anyone with information about what happened should contact police in East Fishkill. There needs to be a thorough investigation into this accident for the sake of all of those that have been affected and so that the family can have closure. We encourage city officials in East Fishkill to take steps to inspect the trees on their roadway in order to help prevent a similar tragedy in the future.
