EAST VILLAGE, NEW YORK (December 24, 2015) – A nail salon worker was injured in an accident after falling through a collapsed sidewalk and into a basement.
For reasons that remain under investigation, the ground gave way outside of the Ultra Nail Salon in Manhattan and sent the worker falling into the basement.
Manhattan police are saying that the employee was trying to open the building at the time of the collapse.
The Department of Buildings issued “aggravated violations” to the property owner for failing “to maintain the building in a safe manner.”
An investigation into the sidewalk collapse and accident outside of the Ultra Nail Salon in East Village remains ongoing at this time.
LIABILITY IN ACCIDENTS INVOLVING A DANGEROUS CONDITION ON A PUBLIC PROPERTY
Generally speaking, a business owner has a responsibility to maintain a reasonably safe environment for the guests that enter their premises. When a business fails to provide a reasonably safe environment for the people that enter their premises, they may be liable in the event of an accident. If a sidewalk collapses, that may be evidence that it hasn’t been properly maintained or inspected. A victim that is injured in a fall due to a dangerous condition on a public property may be entitled to file a claim for damages.
