New York State Trooper Joseph Gallagher Critically Injured In Car Accident After Being Hit By Car On Sagtikos Parkway Freeway On Ramp By Long Island Expressway In Commack
COMMACK, NEW YORK (December 18, 2017) – A New York State Trooper was seriously injured in a car accident on the Sagtikos Parkway Freeway on ramp by the Long Island Expressway in the Commack Area on Monday.
New York State Police have been able to identify the police officer that was injured in the car collision as Joseph J Gallagher. Investigators are saying that Joseph Gallagher was helping a driver whose car had become disabled on the Sagtikos Parkway Freeway On Ramp.
As the New York State Trooper was laying flares in order to warn oncoming drivers, he was struck by a vehicle on the overpass in Commack.
Two cars that were approaching Joseph Gallagher veered right in order to avoid hitting the police officer. Unfortunately, a third vehicle that did not see the New York State Trooper struck him and knocked him to the ground.
Authorities are saying that Joseph Gallagher sustained a very serious head injury and was transported to the Southside Hospital in Bay Shore in order to receive treatment after the Brentwood crash.
The driver involved in the crash remained at the scene and cooperated with investigators. One police officer said that the ramp where the accident took place has a “sharp, hairpin turn” and is “very, very dangerous.”
An investigation into the car accident on the highway on ramp remains ongoing. There have been a number of law enforcement officers that have been killed or seriously injured under similar situations on the Long Island Expressway.
LIABILITY IN CAR ACCIDENTS ON DANGEROUS STRETCHES OF ROAD
Generally speaking, cities have a responsibility to create and maintain roads that are reasonably safe for drivers and pedestrians. When a city fails to maintain a road or there is a dangerous condition with the road, the city may be liable in the event of an accident. If there is a history of similar accidents on a stretch of freeway, that puts the city on notice that there are potential safety issues that need to be corrected. Roads can be dangerous if they are (1) poorly lit, (2) poorly graded to drain water, (3) too narrow, (4) filled with blind turns, (5) filled with sharp turns or for many other reasons. Victims of an accident on a dangerous road may be entitled to damages and the costs of medical treatment.
