LIABILITY IN NURSING HOME FALLS AND ACCIDENTS
Generally speaking, hospitals and nursing homes have a responsibility to provide reasonably prudent health care for their patients. When they fail to provide a reasonable level of care for their patients, they may be liable in the event of an accident. When a patient is being transferred from a bed, there are protocols that should be followed in order to prevent injury or accidents.
According to the National Institute of Health, the patient should be informed of what’s going to happen while being transferred. If they are being moved to a wheelchair, it should be placed next to the bed with the brakes on. A pivot turn should be used while the patient is being supported in order to prevent falls. Unfortunately, patient transfers are often done in a negligent fashion which can result in serious injury or even death.
