LIABILITY IN CAR ACCIDENTS ON DANGEROUS STRETCHES OF ROAD
Generally speaking, property owners have a responsibility to maintain reasonably safe premises for the guests that come to visit. An accident caused by a hazardous condition on the property may impose liability on the property owner. Likewise, cities have a responsibility to maintain reasonably safe roads. In the Court of Appeals case Turturro v City of New York, the court held that a municipality may be held liable for an accident if it has knowledge of a dangerous stretch of roadway and fails to take corrective action to keep citizens safe. In Turturro v City of New York, the city had received numerous complaints about speeding drivers on a stretch of road prior to a 12-year-old boy being seriously injured. The court concluded that a jury could rationally hold the city liable for its lack of “traffic calming measures to deter speeding.”
