The man standing outside of the YMCA waiting for his child was seriously injured in the crash and thrown into the front doors of the YMCA. Tragically, he was later pronounced dead after being hit by the car.
All of the victims that were injured were taken to the Robert Wood Johnson University Hospital in New Brunswick. An investigation into the car accident remains ongoing.
PRODUCT LIABILITY CLAIMS WITH BRAKE FAILURES AND PREMISE LIABILITY CLAIMS WITH CAR ACCIDENTS
The companies that manufacture car brakes have a responsibility to make sure that they are reasonably safe and not likely to malfunction. Unfortunately, design defects with car brakes may contribute to accidents. The manufacturer of the brakes may be liable due to a variety of potential design defects associated with the drums, rotors, break lines or anti-lock systems. In addition to product liability claims, a company like the YMCA may be liable for a dangerous condition on their property. For example, thousands of pedestrians are involved in accidents every year when vehicles run into storefronts. In order to combat this trend pedestrian safety experts recommend utilizing bollard posts.
Our staff at Lipsig Lawyers were deeply saddened to learn about the tragic car accident that killed one man at the YMCA and injured three people. We extend our thoughts and prayers to the victims and their families as they are going through such an incredibly difficult time. We sincerely hope that investigators will examine what happened thoroughly for the sake of all of those that have been affected. Steps need to be taken to prevent similar accidents in the future. Bollard posts at the entrance of this YMCA could help protect pedestrians from errant drivers.
