LIABILITY IN WORKPLACE FALLS
Companies have a responsibility to maintain a reasonably safe environment for workers. This includes making sure that mechanical devices are in working order and that floors are kept clear of hazards like water or grease. In the event that a worker is injured or killed on the job, they or their family will typically have access to workers compensation. In addition to workers compensation, there are laws designed to protect worker’s rights if they are involved in a gravity related accident. Under New York Labor Law 240(1) a worker that is hit by a falling object may be able to file a claim directly against his employer. Under the law, building owners and general contractors are held ultimately responsible for protecting workers from falls and falling objects.
