PRODUCT LIABILITY IN TIRE BLOWOUT ACCIDENTS

Truck drivers have a responsibility to drive in a reasonably safe manner in order to avoid causing an accident. In addition to driving safely, periodic maintenance should be done on a truck’s tires to make sure that they are in good repair and not likely to malfunction. If a truck driver causes an accident or loses control of their vehicle due to poor maintenance, the company that employed the driver may be held liable for the accident. In addition to driver negligence or poor maintenance, the company that manufactures a truck’s tires may also be responsible for a tire blowout accident. Tires do not blowout for no reason. For example, tread belt separations may occur due to improper chemical bonding of the inner and outer sections of the tire. Any person that is injured or has lost someone in an accident due to a tire blowout may be able to file a claim for damages.
