LIABILITY IN TRUCK ACCIDENTS WITH DISABLED VEHICLES
Truck drivers have a responsibility to drive according to the prevailing conditions of the road and to maintain a safe distance with the vehicles in front of them. A truck should never rear-end the vehicle in front of them. That’s usually evidence that they were traveling too fast or maintaining an unsafe distance with the car ahead of them. In addition to driver negligence, there may also be negligence on the part of a guardrail manufacturer if a design defect contributed to an accident. Guardrails are designed to mitigate the impact of a crash and direct cars away from traffic. But a poorly designed guardrail may cause a car to bounce back into the danger of a roadway. Any victim of such an accident may be able to file a products liability claim against the manufacturer of the guardrail.
