WORKER’S COMPENSATION AND THIRD PARTY LIABILITY IN CONSTRUCTION ACCIDENTS

When a worker is injured in New York they will typically have access to the State’s worker’s compensation system in order to help with medical bills and lost wages. In addition to worker’s compensation claims, an injured worker may be able to file a third party liability claim against any entities responsible for the accident. In particular, New York Labor Law 240(1) was designed to hold business owners and general contractors ultimately responsible for gravity related accidents. Business owners must take due care to prevent objects from falling on workers and may be held liable in the event of such an accident. Any construction worker that is injured with a falling object may be able to file a claim for damages.
