LIABILITY IN WORKPLACE ACCIDENTS
Workers in New York will normally be able to file a claim for workers compensation in the event that they are injured on the job. In addition to workers compensation an injured worker may also be able to file a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer causes an accident. For example, if a piece of equipment malfunctions and causes a worker to be injured that may give rise to a third party liability claim.
