LIABILITY IN DUMP TRUCK ACCIDENTS
Generally speaking, dump truck drivers have a responsibility to drive in a reasonably safe manner and keep a watchful eye out for pedestrians and cyclists. If the driver of a dump truck is negligent and causes an accident within the scope of their employment, the company that they work for may be liable. In addition to driver negligence, there may be municipal negligence on the part of a city for failing to correct a dangerous road condition that is contributing to accidents. Any person that is injured in a collision with a negligent truck driver may be able to file a claim for damages including the cost of medical treatment, lost wages and pain and suffering.
Our staff at the Lipsig Firm were deeply concerned to learn about the horrific dump truck accident that injured Ryan Leary on Bushwick Avenue. We extend our thoughts and prayers to the victim as he continues to recover. The Department of Transportation has promised a “safety action plan” for Grand Avenue, but they have yet to deliver. There have been three deaths involving cyclists in the last two years alone. It is time for the Department of Transportation to take action and implement concrete steps to help prevent more accidents like this. There needs to be more protections put in place to help keep cyclists safe. We encourage anyone that is able to donate to the GO FUND ME page that has been set up for the victim.
