LIABILITY IN SCAFFOLD ACCIDENTS
New York Labor Law 240(1) protects workers in the event that a person is injured or killed after falling off of a scaffold. Ultimate responsibility rests with general contractors and building owners to make sure that scaffolds are safe. It’s extraordinarily important that scaffolds are adequately secured and that workers are given the safety tools necessary to decrease the likelihood of falls. Unfortunately, this doesn’t always happen. The family of a victim in a scaffold accident will typically be able to file a claim for damages.
