As recently reported in the New York Post, in 2011, customers in New York City were struck by subway trains a staggering 147 times in 2011, and 128 times in 2010.

That is a two-year total of 275 people in New York City who were struck by subway trains, a frequency of almost 3 a week. Fatal subway accidents have become such a common occurrence that these incidents are not even reported in the press anymore.
Our firm has successfully represented many people who have been struck and either severely injured or killed when struck by subway trains. We achieved a verdict in excess of $10 million in a case in the Bronx last year.

Subway Incidents in NYC Can Be Caused By a Combination of the Train Operator’s Inattentiveness

Our investigations often disclose that these incidents are in part caused by a combination of the train operator’s inattentiveness, or failure to act immediately, and stop the train in the emergency stopping mode, once they spot what appears to be an obstruction on the tracks. Of the more that one dozen people we have represented who have been struck by trains, they weren’t injured by falling on the tracks, they were injured when a train did not stop in time.

Unfortunately, it is almost impossible to discover the true facts without retaining counsel. We have the ability to obtain all of the official reports of the incident, information downloaded from the train’s event data recorder (“black box”), and even the taped voice transmissions from the train operator and other personnel on the scene, which will assist us in reconstructing the accident, and finding out what really happened.
If you or a loved one finds themselves in this unfortunate situation, do not hesitate to contact expert accident attorneys at Lipsig for the sooner, the better.

On May, 9 2011, our client and Lipsig partner attorney, Alan Shapey, together heard the long-awaited verdict of a three-week jury trial involving a injuries caused by a NYC subway train,. Our client is the severely injured accident victim who suffered catastrophic injuries on September 3, 2007 when he was struck by a subway train.

The case first began in September 2007, when our client was struck by an NYC subway train after falling onto the elevated train tracks in the Bronx Our law firm began work shortly later and continues to represent the victim of these terrible injuries.

The case clearly put Mr. Shapey’s own trial attorney skills to the test, but through his courtroom legal work and our law firm’s use of intensive investigation and pre-trial discovery, he was able to get his client the verdict he deserved.

The NYC Subway operator testified that she first saw something on the tracks only as she was already passing it and therefore claimed that she did not have time to stop. Luckily, the accident victim contacted Lipsig, a law firm that is widely known for its successful verdicts for its clients who have been injured in NYC subway accidents..

It was Shapey’s court room skills combined with the Lipsig law firm’s full support and abilities that ultimately led to the $10million verdict. He was able to obtain a copy of the radio and phone log between the train operator, the dispatchers, and other transit employees at the scene.

The log directly contradicted the train operator’s testimony.

The pivotal point in the trial was when Mr. Shapey played a tape recording of the operator’s voice demonstrating that within minutes of the NYC subway accident, she denied her train had struck Shapey’s client, even though we proved that she knew that he was alive and lying under the third car of her train and with severe injuries to both of his legs and one of his arms.

It was a hard-fought battle that ended in a great victory for our client and for Mr. Shapey, a Lipsig NYC subway accident attorney.

From tragic yet preventable accidents in Central Park to severe injuries at your work place, when you are injured in a situation where you were not in control, you should consult with a personal injury lawyer.

One tragic example of a dire situation where a personal injury lawyer is needed is the case of the grieving family of a 40 year old worker who fell victim to a falling branch of a tree in Central Park at the very-heavily used Literary Walk; the branch of a tree snapped and fell. He was killed when the branch hit him as it fell to the ground. The tree had been inspected and categorized as “dangerous” at least two times in the few months before this preventable accident.

Unfortunately, this is not the first nor the only example of New Yorkers who have been killed or seriously injured by falling Central Park tree branches. The Lipsig Law firm is suing the Central Park Conservancy that is responsible for the maintenance of the 26,000 trees in Central Park; the tree that killed our client was inspected and the inspections revealed that it posed a hazard; sadly, it was not removed before this tragic death.

Alan Shapey- Lipsig Law firm – Personal Injury Lawyer for major Central Park accident

Who is to blame for this tragic, yet preventable accident? The City of New York and the Central Park Conservancy actively maintain the trees and the grounds in Central Park; one of New York City’s most famous and most used areas.

One of the Lipsig Law firm’s partners, personal injury lawyer Alan Shapey, is actively working for the family and in the course of his investigation, he has determine that negligence by the Central Park Conservancy and by the City of New York was the cause of this unnecessary death.

Mr. Shapey and the Lipsig Law Firm represent the family of a man who was killed in the same way as the six-month-old girl who was killed by a falling branch in the Central Park Zoo and the Google engineer who was badly injured by a falling branch.
Alan Shapey and the Lipsig Law Firm have taken all of the needed steps as the family’s personal injury lawyer. Mr. Shapey has investigated and discovered that, prior to our client’s death, this specific tree had been deemed dangerous by an inspection for the Central Park Conservancy and was given a high priority for removal, but it remained in place until two and a half months later, when it killed this young husband and father of two sons.

Personal injury lawyer to 35 million people

After questioning why the tree was never removed, and who was responsible for the removal, Shapey has revealed the unsatisfactory upkeep of the park’s trees and has commented on the lack of efforts to protect the many people that frequent the park every day.

“I can’t be walking through Central Park looking at trees, wondering which one is going to hit me,” he said in a NY Times interview. “Do I have to wear a hard hat?”

The personal injury lawyer asked this question on behalf of all Central Park visitors who have no idea of the dangers that they face by walking the Park’s tree lined paths. By bringing this serious matter to the courtroom, he is helping to protect the 35 million annual visitors of the enormous park.

Lipsig not only stands for all victims of Central Park accidents but for other personal injuries as well. If you or a loved one has sustained a serious injury, contact an attorney at Lipsig, Shapey, Manus & Moverman.

On Monday, December 20th actor Christopher Tierney, performing in the previews of the new Broadway blockbuster, “Spider-Man” sustained serious injuries when an insecure cable attachment for a major stunt caused the actor to fall nearly 30 feet from a landing onto the stage below.

Lipsig’s Alan Shapey represents a Broadway actor who was injured in 2008 while working in the Disney production of the Little Mermaid in a very similar fall on the set. Mr. Shapey, one of the Lipsig Law Firm partners was asked to comment when media station NY1 covered the story of this latest injury at the Spider-Man production.

Personal injury lawyer, Alan Shapey comments on NY1

“There must be systems in place that anticipate the way a system can fail and there must be redundant safety systems, so if one system fails there’s another one in place,” Shapey said during his interview. Shapey attributes actor Tierney’s disastrous injuries to a lack of safety systems on the Spiderman set.

The personal injury lawyer Alan Shapey has close to 30 years experience legally representing those who have been injured and he believes that the reasons behind Tierney’s injuries and the injuries at other Broadway shows are completely unacceptable.

During their legal work for the injured performer at the Little Mermaid production, the attorneys at the Lipsig Law Firm retained engineers and other experts to assess how the production and sets should have been constructed and operated to provide safety to the creative actors who work on Broadway shows.

This is not the first time a personal injury lawyer has been called to Broadway for injured performers

Tierney is not the first actor in the $65 million production who has been injured while on set. Actress Natalie Mendoza, Tierney’s co-star, suffered a concussion during the first preview performance. Although this has not yet been confirmed, she is now rumored to be leaving Spider-Man as a result of Tierney’s injuries.

The hope of the personal injury lawyers at the Lipsig Law Firm who represent injured Broadway performers is that their legal work will benefit all actors who have to perform dangerous stunts in the future by creating better safety standards.

If you or a loved one has sustained a serious fall and injury, contact an attorney at Lipsig, Shapey, Manus & Moverman.

If you are hurt in any type of accident, the most important thing is your health. Please see your healthcare provider first and get the medical care that you need. Your health is paramount to all else! Your very next step should be to call a personal injury lawyer at Lipsig, Shapey, Manus, and Moverman to protect your rights. There are a several good reasons for contacting your personal injury lawyer right away.

A lawyer can help to get you on the correct legal course. There are many laws and regulations that must be followed to ensure you have a strong case. For instance, an accident report must be filed after any automobile accidents resulting in either any personal injury or in $1000 or more in property damages. In New York, the injured persona from a car accident must find out the full insurance information of the vehicle who caused the injury and file, within only 30 days, the needed No-Fault application.

In addition, in almost all cities and municipal agencies, there are very short statutes of limitations required for filing your case. These differ in each city, town and government agency and also can vary based on the different types of injury cases. So it is best to speak to a lawyer right away to allow the lawyer to determine what applies in your case and to do the necessary filing in a timely way.

As we mentioned in an earlier blog, What does a personal injury lawyer do to earn their fee?, there is no initial charge to speak to a lawyer at Lipsig, Shapey, Manus, and Moverman to find out if you have a potential personal injury case. You are only going to pay a legal fee if and when you win your case and recover for your injury and damages. It is best to speak to an experienced personal injury lawyer to learn about your rights when going up against an insurance company, a corporation or a government agency.

Right after an accident happens, insurance companies sometimes send employees or investigators to the hospital to try to get patients to settle quickly without a lawyer or to obtain a written or tape-recorded statement that can adversely affect the injured person’s success in their case. There type of hospital or home visits from the insurance representatives usually result in the injured person and their family receiving a lot less than they deserve and need. Do not fall victim to this type of agreement or tactic. As soon as your immediate health needs are met at a doctor’s office or hospital, call 1-800-9-LIPSIG right away and we will go to work to help you and your family.

Sadly, we often hear in the news of a worker being seriously injured, maimed or even killed at their workplace. These stories are tragic and far reaching beyond just one incident. There are government agencies that are in charge of the safety standards that must be followed at workplaces across the USA. However, we have seen that frequently there is little or no agency action taken or safety inspections made before a serious work site injury or an on-the-job death. The U.S. government runs the Occupational Safety and Health Administration (OSHA) that is responsible to make the rules and to enforce them to keep workers safe and healthy at their work places. Many states have their own similar agencies.

If you are injured on the job, you are usually eligible to receive workers compensation insurance benefits while you are being medically treated for your injuries and trying to recover. The medical bills can add up to a substantial sum of money so you should submit all bills and expenses for your medical treatment to the workers compensation carrier. The law firm of Lipsig Shapey Manus & Moverman can help you get the legal help you may need when dealing with workers compensation issues. With the help of our lawyers, you can usually dispute any denial by the insurance company of payment for your medical care or for your lost wages.

On the job injuries also can cause you to lose wages and may reduce or even totally eliminate your ability to return to work in the future. If your injury has caused permanent disability or reduced your future ability to work, you should contact a personal injury lawyer at Lipsig, Shapey, Manus and Moverman to find out if you are entitled to money damages for both pain and suffering and for your economic losses beyond the workers compensation wage payments you should be receiving.

If you believe that machinery on your job was dangerous or was negligently designed for safety, you may have a personal injury products liability case. Lipsig, Shapey, Manus and Moverman is a law firm that concentrates in and prosecutes many cases where worker safety and/or dangerous machinery is the most significant issue. The lawyers at the Lipsig law firm will take a detailed and in-depth look at the facts of your case, using competent experts to analyze the facts and to determine who was responsible for your injuries. The lawyers at Lipsig will assess all of the parties that should be brought into the case as defendants to fully protect your rights

If you are ever hurt or become sick on your job because your company has not properly protected you, you may have the right to sue a third-party for damages. It is important that people stand up for themselves since the cases that the Lipsig law firm brings on behalf of its client can help to force changes in work place safety that will hopefully prevent future similar injuries to other people at their jobs.

Generally neither the company you work for, your boss nor your co-workers can be held legally responsible for your on-the-job injuries due to the workers compensation law. If the cause of your injury was some workplace machinery’s poor design or inadequate safety, you may be able to recover for your injuries and damages, even if you are receiving workers compensation benefits or social security disability payments. After a thorough investigation with highly skilled experts, the lawyers at the Lipsig Law Firm will prosecute your case in court by starting a lawsuit against the legally responsible parties.

The lawyers at Lipsig Shapey Manus & Moverman will begin and will takecare of the entire legal action until you have received your full damages either through a settlement or through a jury verdict in court.

If you have any questions about your rights after an injury sustained at work or a medical disease that began at your work place, please call Tom Moverman at Lipsig Shapey Manus & Moverman, 212-285-3300, 1-800-9–LIPSIG or email to: tmoverman@lipsig.com.
