Aliem Davis and Elliot Rodriguez Died In Highway Car Accident After Their 1995 Acura Hit Tree On Southern State Parkway

BAY SHORE, NEW YORK (February 11, 2017) – Two men were tragically killed in a single-vehicle car accident on the Southern State Parkway when their car left the road and struck a tree in the center median.

Bay Shore authorities have been able to identify the people that died in the car crash as Aliem Davis and Elliot Rodriguez.

Aliem Davis was the driver of the car and Elliot Rodriguez was his passenger when the vehicle they were in left the road and hit several trees that separate the two sides of the freeway.

Firefighters and paramedics rushed to the scene of the car collision in order to treat the victims for their injuries.

Tragically, Aliem Davis and Elliot Rodriguez were both pronounced dead at the scene. An investigation into the car accident remains ongoing at this point.

There have been a number of fatal accidents on the Southern State Parkway freeway where vehicles have run into trees.

Last August, a 54-year-old man was killed after his vehicle left the roadway and hit a tree.

In 2012, four people were killed after their vehicle left the road and came into contact with an unprotected tree.

LIABILITY IN ROADSIDE ACCIDENTS WITH FIXED OBJECTS

Cities in New York have a responsibility to maintain reasonably safe roadways in order to protect drivers. This also includes taking measures to protect errant drivers that may leave the roadway for one reason or another. Fixed objects like polls and trees can be a lethal hazard when they are unprotected by guardrails and within a short distance of the roadway. Courts in New York have generally ruled that cities have a responsibility to remove fixed objects or install guardrails around them when there is a (1) significant roadside construction on a stretch of road or (2) a pointed history of accidents on a particular road. Guardrails help protect errant vehicles from potentially deadly accidents with fixed objects like trees and their absence may impose liability on a city.
