LIABILITY IN INDUSTRIAL ACCIDENTS
When a worker is injured in an industrial accident, they will typically be able to file a claim for worker’s compensation. In addition to worker’s compensation, an injured worker may be able to file a third party liability claim against any other entities that may have been responsible for the accident. For example, if a piece of machinery malfunctions and causes a worker to be injured, they may be able to file a products liability claim. In particular, the manufacturer of a conveyor belt may be held liable for a worker’s injuries if the belt was partially or completely unguarded. Improperly assembled conveyor belts may also place employees at undue risk and increase the likelihood of injury. Any person injured by a defective conveyor belt may be able to receive compensation for their medical expenses, pain and suffering and lost income.
